(a) A public official, while acting in an official capacity, exceeds lawful authority identified by statute, court order, or duly promulgated regulation, or fails to perform a non-discretionary duty imposed by statute, court order, or duly promulgated regulation.

Chapter 2: Obstruction of Government Operations
Section 1521 Obstruction of Government OperationsMISDEMEANOR#
(a) Interfering with the lawful performance of duties by a public agency or public servant by physical obstruction, intimidation, deception, or refusal to comply with a lawful order that materially delays or prevents the duty.
(b) Penalties:
(1) Fine: $2,000 to $7,500
(2) Imprisonment: 5 to 15 minutes
(3) Bail: $5,000 to $22,500
Section 1522 Impersonation of a Public OfficialFELONY#
(a) Falsely representing oneself as a public official to obtain compliance, access, information, or benefit.
(b) Penalties:
(1) Fine: $25,000 to $75,000
(2) Imprisonment: 20 to 40 minutes
(3) Bail: $75,000 to $225,000
Section 1523 Tampering With Government RecordsFELONY#
(a) Altering, destroying, concealing, or falsifying a government record.
(b) Penalties:
(1) Fine: $50,000 to $150,000
(2) Imprisonment: 30 to 60 minutes
(3) Bail: $150,000 to $450,000
Section 1524 Witness or Complainant Intimidation in Government ProceedingsFELONY#
(a) Using threats, force, or coercion to influence, prevent, or retaliate against participation in a government investigation or proceeding.
(a) Upon a showing of probable cause that a public official committed a felony under this Title, a court may order temporary suspension from duties where necessary to protect the integrity of government operations or public safety.
(b) The court may impose conditions including no-contact orders, restrictions on access to government systems, and surrender of government-issued credentials.
(c) Suspension under this section shall be narrowly tailored and subject to modification upon motion.
(d) An order issued under this section shall be set for status review upon request of either party.
(a) Upon conviction of a felony under this Title, the court may order removal from office as part of the judgment.
(b) The court may stay removal pending appeal where justice so requires.
Section 1543 Disqualification From Public Service#
(a) Upon conviction of a felony under this Title, the court may order disqualification from holding public office or public employment for a period of 7 to 30 days, or longer where authorized by other law.
(b) In determining duration, the court shall consider the nature of the offense, the position held, and the risk of recurrence.
(a) In addition to any fine or imprisonment, the court shall order restitution for proven losses caused by conduct under this Title.
(b) Restitution may include repayment of misused public funds and documented investigative or remediation costs.
Chapter 5: Jurisdiction, Charging, and Judicial Discretion
Section 1551 Official Capacity and Color of Authority#
(a) An offense under this Title may be charged when conduct is committed while acting, purporting to act, or leveraging the appearance of acting under governmental authority.
(b) This Title shall be construed to preserve lawful discretion exercised in good faith within the scope of duty.
(a) Conduct punishable under this Title may also be charged under any other applicable Title.
(b) Nothing in this Title limits lawful administrative discipline by the relevant agency.
Chapter 6: Deprivation of Rights Under Color of Law
Section 1561 Deprivation of Rights Under Color of LawFELONY#
(a) A public official, while acting or purporting to act under governmental authority, deprives a person of rights secured by the Constitution of the State of San Andreas or by statute.
(a) A public official conducts or causes a search or seizure without lawful justification.
(b) Penalties:
(1) Fine: $50,000 to $200,000
(2) Imprisonment: 30 to 60 minutes
(3) Bail: $150,000 to $600,000
Section 1565 Denial of Access to CounselMISDEMEANOR#
(a) A public official unlawfully prevents or unreasonably delays access to an attorney after a person requests counsel in connection with detention, questioning, or criminal proceedings.
(a) A public official subjects a person in custody to cruel, degrading, or dangerous treatment, or denies necessary medical care.
(b) Penalties:
(1) Fine: $75,000 to $250,000
(2) Imprisonment: 35 to 60 minutes
(3) Bail: $225,000 to $750,000
Section 1567 Evidence Tampering Under Color of LawFELONY#
(a) A public official fabricates, alters, destroys, conceals, or plants evidence in connection with an investigation or prosecution.
(b) Penalties:
(1) Fine: $100,000 to $250,000
(2) Imprisonment: 40 to 60 minutes
(3) Bail: $300,000 to $750,000
Section 1568 Retaliation for Exercise of RightsFELONY#
(a) A public official uses official power to punish, threaten, or target a person for exercising rights secured by the Constitution or laws of this State.
(b) Triggered when: The offense is committed while using, displaying, or having a deadly weapon readily accessible in a manner that facilitates the offense.
(b) Triggered when: The defendant has a prior conviction for an offense under this Title with a conviction date within 30 days before the conviction date for the current offense.
(c) Additional Penalties:
(1) Second offense: Fine and imprisonment increased by 50%
(2) Third offense: Fine and imprisonment increased by 100%
(3) Fourth and subsequent: Fine and imprisonment increased by 200%
