Chapter 1: Environmental Protection

Section 1701 Illegal DumpingMISDEMEANOR#

  • (a) Disposing of refuse, waste, or discarded material in a public place or on property without authorization.
  • (b) Penalties:
    • (1) Fine: $2,000 to $8,000
    • (2) Imprisonment: 5 to 15 minutes
    • (3) Bail: $4,000 to $24,000

Section 1702 Environmental ContaminationFELONY#

  • (a) Releasing or causing the release of hazardous substances in a manner that creates a substantial risk to public health or the environment.
  • (b) Penalties:
    • (1) Fine: $50,000 to $150,000
    • (2) Imprisonment: 30 to 60 minutes
    • (3) Bail: $150,000 to $450,000

Section 1703 Destruction of Protected Natural AreasMISDEMEANOR#

  • (a) Damaging or destroying protected vegetation, habitat, or designated natural areas without authorization.
  • (b) Penalties:
    • (1) Fine: $3,000 to $10,000
    • (2) Imprisonment: 5 to 15 minutes
    • (3) Bail: $6,000 to $30,000

Section 1704 Unlawful Open BurningINFRACTION#

  • (a) Setting or maintaining an open fire in violation of posted restrictions or lawful emergency orders.
  • (b) Penalties:
    • (1) Fine: $500 to $2,000
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,000 to $6,000

Section 1705 Restitution and Remediation Orders#

  • (a) Upon conviction under this Chapter, the court may order restitution for documented costs that are reasonably attributable to cleanup, containment, and environmental remediation caused by the offense conduct.
  • (b) Restitution under this Section shall be based on itemized documentation and may be determined after a restitution hearing upon request of any party.
  • (c) The court may order community service reasonably related to cleanup or restoration, and may structure payment plans or convert a portion of restitution into supervised community service when appropriate.

Chapter 2: Animal Control and Public Safety

Section 1711 Animal NeglectMISDEMEANOR#

  • (a) Failing to provide necessary care to an animal in one’s custody, resulting in harm or a substantial risk of harm.
  • (b) Penalties:
    • (1) Fine: $2,000 to $8,000
    • (2) Imprisonment: 5 to 15 minutes
    • (3) Bail: $4,000 to $24,000

Section 1712 Animal CrueltyFELONY#

  • (a) Torturing, maiming, or causing severe suffering to an animal.
  • (b) Penalties:
    • (1) Fine: $50,000 to $125,000
    • (2) Imprisonment: 30 to 60 minutes
    • (3) Bail: $150,000 to $375,000

Section 1713 Dangerous Animal at LargeMISDEMEANOR#

  • (a) Allowing a dangerous animal to roam uncontrolled in a manner that endangers persons or property.
  • (b) Penalties:
    • (1) Fine: $3,000 to $10,000
    • (2) Imprisonment: 5 to 15 minutes
    • (3) Bail: $6,000 to $30,000

Section 1714 Interference with Animal ControlINFRACTION#

  • (a) Obstructing, delaying, or refusing lawful directions of animal control personnel or a peace officer during an animal control incident.
  • (b) Penalties:
    • (1) Fine: $500 to $1,500
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,000 to $4,500

Section 1715 Seizure and Impoundment Authority#

  • (a) A peace officer or authorized animal control personnel may seize and impound an animal when necessary to prevent imminent harm, to preserve evidence, or pursuant to a lawful court order.
  • (b) Seized animals shall be handled humanely and held consistent with written agency policy and applicable court orders.
  • (c) Upon request by an owner or custodian, the court shall provide prompt post-seizure judicial review on the next available docket to determine whether continued impoundment is warranted and under what conditions.
  • (d) The court may order forfeiture, return, or conditions of return, including reasonable costs of care and reasonable safety conditions.

Chapter 3: Trespass on Restricted Facilities and Critical Sites

Section 1721 Trespass on Restricted FacilityMISDEMEANOR#

  • (a) Entering or remaining on a restricted facility after notice that entry is prohibited.
  • (b) Penalties:
    • (1) Fine: $2,000 to $7,000
    • (2) Imprisonment: 5 to 12 minutes
    • (3) Bail: $4,000 to $21,000

Section 1722 Trespass with Disruption of OperationsMISDEMEANOR#

  • (a) Trespassing on a restricted facility in a manner that materially disrupts operations, services, or lawful activities.
  • (b) Penalties:
    • (1) Fine: $5,000 to $12,000
    • (2) Imprisonment: 10 to 20 minutes
    • (3) Bail: $10,000 to $36,000

Section 1723 Sabotage of Critical InfrastructureFELONY#

  • (a) Damaging, disabling, or tampering with critical infrastructure in a manner that creates a substantial risk to public safety or essential services.
  • (b) Penalties:
    • (1) Fine: $100,000 to $250,000
    • (2) Imprisonment: 45 to 60 minutes
    • (3) Bail: $300,000 to $750,000

Section 1724 Refusal to Depart Restricted FacilityINFRACTION#

  • (a) Refusing a lawful order to depart a restricted facility when the person has no lawful purpose to remain.
  • (b) Penalties:
    • (1) Fine: $500 to $1,500
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,000 to $4,500

Chapter 4: Special Events, Permits, and Crowd Safety

Section 1731 Unpermitted Special EventINFRACTION#

  • (a) Organizing or conducting a special event requiring a permit without obtaining the required permit.
  • (b) Penalties:
    • (1) Fine: $750 to $2,000
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,500 to $6,000

Section 1732 Violation of Special Event Safety ConditionsINFRACTION#

  • (a) Violating reasonable safety conditions imposed by permit, posted rules, or lawful on-scene direction for a permitted event.
  • (b) Penalties:
    • (1) Fine: $500 to $2,000
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,000 to $6,000

Section 1733 Disorderly Conduct at Special EventMISDEMEANOR#

  • (a) Engaging in violent, tumultuous, or disruptive conduct at a special event that creates a substantial risk to public safety.
  • (b) Penalties:
    • (1) Fine: $2,000 to $7,000
    • (2) Imprisonment: 5 to 15 minutes
    • (3) Bail: $4,000 to $21,000

Section 1734 Emergency Closure and Dispersal Authority#

  • (a) When a peace officer or authorized public safety official reasonably determines that a special event or gathering presents an imminent threat to public safety, the official may order dispersal, impose temporary access restrictions, or close the area for the minimum time and scope reasonably necessary.
  • (b) When feasible, an order under this Section shall include a clear dispersal route or exit direction and a reasonable time to comply under the circumstances.
  • (c) Orders issued under this Section shall be communicated by reasonable means under the circumstances.

Chapter 5: Uncommon and Catch-All Public Order Offenses

Section 1741 False Emergency ReportMISDEMEANOR#

  • (a) Making a false report that an emergency exists, causing public safety resources to be dispatched or diverted.
  • (b) Penalties:
    • (1) Fine: $5,000 to $15,000
    • (2) Imprisonment: 10 to 20 minutes
    • (3) Bail: $10,000 to $45,000

Section 1742 Interference with Emergency OperationsMISDEMEANOR#

  • (a) Obstructing, delaying, or interfering with lawful emergency operations of public safety personnel during an active emergency response.
  • (b) Penalties:
    • (1) Fine: $3,000 to $10,000
    • (2) Imprisonment: 10 to 20 minutes
    • (3) Bail: $6,000 to $30,000

Section 1743 Unlawful Use of Emergency SignalsINFRACTION#

  • (a) Using emergency lights, sirens, or emergency markings on a vehicle without lawful authorization.
  • (b) Penalties:
    • (1) Fine: $750 to $2,000
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,500 to $6,000

Section 1744 Public NuisanceINFRACTION#

  • (a) Creating a condition in a public place that unreasonably interferes with public health, safety, or the use of public space after notice to abate.
  • (b) Penalties:
    • (1) Fine: $500 to $2,000
    • (2) Imprisonment: 0 to 3 minutes
    • (3) Bail: $1,000 to $6,000

Section 1745 Restitution for Public Resource Misuse#

  • (a) Upon conviction under this Chapter, the court may order restitution for itemized and documented public costs that are reasonably attributable to the conduct, including emergency response costs.
  • (b) Upon request of any party, restitution under this Section shall be determined after a restitution hearing.
  • (c) The court may reduce or waive restitution otherwise authorized by this Section when the public response was unreasonable or materially escalated beyond what the conduct warranted.
  • (d) Restitution ordered under this Section shall be in addition to any fine.

Chapter 6: Enhancements

Section 1750 Deadly Weapon EnhancementEnhancement#

  • (a) Applies to: All offenses under this Title.
  • (b) Triggered when: The offense is committed while a deadly weapon is displayed, used, or possessed in a manner that facilitated or escalated the offense.
  • (c) Additional Penalties:
    • (1) Additional Fine: $10,000 to $20,000
    • (2) Additional Imprisonment: 10 to 20 minutes

Section 1751 Serious Bodily Injury EnhancementEnhancement#

  • (a) Applies to: All offenses under this Title.
  • (b) Triggered when: The offense results in serious bodily injury, as found by the court based on medical evidence or other reliable proof of seriousness and causation.
  • (c) Additional Penalties:
    • (1) Additional Fine: $15,000 to $30,000
    • (2) Additional Imprisonment: 15 to 30 minutes

Section 1752 Vulnerable Victim EnhancementEnhancement#

  • (a) Applies to: All offenses under this Title that involve an identifiable victim.
  • (b) Triggered when: The victim is elderly, disabled, a minor, or a public official acting in an official capacity and targeted because of that status.
  • (c) Additional Penalties:
    • (1) Additional Fine: $10,000 to $25,000
    • (2) Additional Imprisonment: 10 to 20 minutes

Section 1753 Repeat Offender EnhancementEnhancement#

  • (a) Applies to: All offenses under this Title.
  • (b) Triggered when: The defendant has a prior conviction for an offense under this Title, and the conviction date for the prior offense is within 30 days before the commission date of the current offense.
  • (c) Additional Penalties:
    • (1) Second offense: Fine and imprisonment increased by 50%
    • (2) Third offense: Fine and imprisonment increased by 100%
    • (3) Fourth and subsequent: Fine and imprisonment increased by 200%
