Section 601 Unlicensed Carry of a WeaponMISDEMEANOR#
(a) A person shall not carry a weapon on their person, or in a vehicle under their control, without a valid weapons license issued or recognized by the State of San Andreas.
(a) A person shall not display or handle a weapon in a threatening manner in a public place or in the presence of another person without lawful justification.
(b) Penalties:
(1) Fine: $3,000 to $10,000
(2) Imprisonment: 10 to 20 minutes
Section 612 Negligent Discharge of a WeaponMISDEMEANOR#
(a) A person shall not discharge a weapon in a manner that creates an unreasonable risk to persons or property.
(a) A person shall not discharge a weapon within a city, town, or other populated area, except as lawfully justified or expressly authorized.
(b) Penalties:
(1) Fine: $25,000 to $75,000
(2) Imprisonment: 25 to 55 minutes
Section 614 Discharge of a Weapon at an Occupied Vehicle or StructureFELONY#
(a) A person shall not discharge a weapon at an occupied vehicle or an occupied structure.
(b) Penalties:
(1) Fine: $75,000 to $175,000
(2) Imprisonment: 45 to 75 minutes
Chapter 3: Prohibited Weapons and Dangerous Items
Section 621 Possession of a Prohibited WeaponFELONY#
(a) A person shall not possess a prohibited weapon.
(b) Penalties:
(1) Fine: $30,000 to $100,000
(2) Imprisonment: 25 to 55 minutes
Section 622 Possession of a Prohibited Attachment or Conversion DeviceFELONY#
(a) A person shall not possess an attachment, part, or device intended to materially increase a weapon’s rate of fire or otherwise convert it for unlawful use.
(b) Penalties:
(1) Fine: $35,000 to $125,000
(2) Imprisonment: 30 to 60 minutes
Section 623 Possession of an Explosive or Incendiary DeviceFELONY#
(a) A person shall not possess an explosive or incendiary device except as expressly authorized by law.
(b) Penalties:
(1) Fine: $100,000 to $250,000
(2) Imprisonment: 45 to 90 minutes
Section 624 Manufacture or Assembly of a Prohibited Weapon or DeviceFELONY#
(a) A person shall not manufacture, assemble, or cause to be manufactured or assembled a prohibited weapon, prohibited attachment, explosive, or incendiary device.
(b) Penalties:
(1) Fine: $125,000 to $300,000
(2) Imprisonment: 60 to 110 minutes
Chapter 4: Weapons in Sensitive Places and Public Safety Restrictions
Section 631 Weapon in a Restricted Government FacilityMISDEMEANOR#
(a) A person shall not carry a weapon into a restricted government facility where weapons are posted as prohibited or where screening is in place.
(b) Penalties:
(1) Fine: $2,000 to $7,500
(2) Imprisonment: 5 to 15 minutes
Section 632 Weapon at a Public DemonstrationMISDEMEANOR#
(a) A person shall not carry a weapon while participating in a public demonstration when the person’s conduct reasonably creates a risk of intimidation or escalation of violence.
(b) Penalties:
(1) Fine: $3,000 to $9,000
(2) Imprisonment: 5 to 15 minutes
Chapter 5: Seizure, Forfeiture, and Return (Authority and Procedure)
Section 641 Seizure of Weapons and Dangerous Items#
(a) A peace officer may seize a weapon or dangerous item when the officer has lawful grounds to arrest for an offense under this Title, or when the item is reasonably believed to be contraband or evidence of an offense.
(b) A seized item shall be inventoried and handled in accordance with agency evidence procedures.
(c) A peace officer may temporarily secure a weapon for public safety during a lawful stop and shall return it when the basis for securing it ends, unless the weapon is seized under subsection (a).
(a) Upon conviction of an offense under this Title, the court may order forfeiture of any weapon, prohibited attachment, explosive, incendiary device, or other dangerous item possessed, used, or involved in the offense.
(b) The court may order destruction of contraband items and may order lawful disposition of non-contraband items consistent with public safety.
(c) The court may order restitution for damage caused by unlawful discharge or use of a weapon in addition to any fine imposed.
